Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the University Bubble mobile application ("App"), website ("Site"), and related services (collectively, the "Service"), operated by University Bubble ("we," "us," or "our").

By creating an account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

2. Eligibility

2.1 Registered Accounts

To create an account and access full features (Bubbles, Direct Messages, Dashboard), you must:

• Be enrolled at Auburn University and hold a valid @auburn.edu email address.
• Be at least 17 years of age.
• Have the legal capacity to enter into a binding agreement.
• Not have been previously banned or suspended from University Bubble.
• Not be prohibited from using the Service under applicable law.

By registering, you represent and warrant that you meet all of the above eligibility requirements. We reserve the right to verify your Auburn University affiliation and to suspend or terminate accounts that no longer meet these requirements (e.g., upon graduation or withdrawal from Auburn).

2.2 Guest Access

University Bubble offers limited guest access to housing and dining information without requiring account registration. Guest users may browse these features but may not access messaging, group chats, direct messages, or the Dashboard. Guest users must also be at least 17 years of age and agree to these Terms by using the Service. All other Terms, including Acceptable Use and Limitation of Liability, apply equally to guest users.

University Bubble is not affiliated with, endorsed by, or officially sponsored by Auburn University.

3. Account Registration & Security

To access full features of the Service, you must create an account using your @auburn.edu email address. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information to keep it accurate.
• Keep your password confidential and not share your account credentials with anyone.
• Notify us immediately at support@universitybubble.com if you suspect unauthorized access to your account.
• Accept responsibility for all activity that occurs under your account.

One account per person. Creating multiple accounts is prohibited.

4. Acceptable Use

You agree to use University Bubble only for lawful purposes and in compliance with these Terms. You agree not to:

4.1 Prohibited Content

• Post, share, or transmit content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
• Share content that constitutes hate speech, discrimination, or promotes violence against any individual or group.
• Post sexually explicit or pornographic material.
• Share content that infringes any patent, trademark, copyright, or other intellectual property right.
• Disseminate false or misleading information.
• Share spam, unsolicited advertising, or promotional materials.

4.2 Prohibited Conduct

• Impersonate any person or entity, including Auburn University officials or University Bubble staff.
• Harass, bully, stalk, or intimidate any user.
• Collect or harvest any personally identifiable information from other users without consent.
• Circumvent, disable, or interfere with security features of the Service.
• Use automated bots, scrapers, or scripts to access or interact with the Service.
• Attempt to gain unauthorized access to any portion of the Service or its related systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Use the Service to facilitate any illegal activity.

4.3 Academic Integrity

University Bubble may be used to facilitate academic collaboration and discussion. You agree not to use the Service to facilitate academic dishonesty, including sharing exam answers, facilitating cheating, or violating Auburn University's Academic Honesty Code. You are solely responsible for ensuring your use of the Service complies with Auburn University's academic integrity policies.

5. User Content

5.1 Your Content

"User Content" means any messages, text, photos, files, or other materials you post or transmit through the Service. You retain ownership of your User Content.

5.2 License to University Bubble

By posting User Content, you grant University Bubble a non-exclusive, worldwide, royalty-free, sublicensable license to use, store, display, and distribute your User Content solely for the purpose of operating and providing the Service. This license ends when you delete your User Content or your account.

5.3 Responsibility for Content

You are solely responsible for your User Content. We do not endorse, verify, or guarantee the accuracy of any User Content posted by users. By posting User Content, you represent and warrant that you have all necessary rights to post such content and that it does not violate these Terms or any applicable law.

5.4 Content Removal

We reserve the right (but have no obligation) to review, monitor, remove, or disable access to any User Content at our sole discretion, at any time, without notice, for any reason, including if we believe it violates these Terms.

6. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and share information about you. By using the Service, you consent to our data practices as described in the Privacy Policy.

7. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by University Bubble and are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from our Service, except as permitted by these Terms.

The name "University Bubble," the app icon, and all related marks are our trademarks. You may not use our trademarks without our prior written consent.

8. Third-Party Services & Links

The Service may contain links to third-party websites or services, including Auburn University's official resources, restaurant websites, and other external content. We are not responsible for the content, privacy practices, or terms of any third-party sites. Accessing third-party links is at your own risk.

The Service uses Supabase for database and authentication services, and Expo for push notifications. Your use of the Service is also subject to Supabase's and Expo's respective terms of service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF DEALING.

We do not warrant that: (a) the Service will be uninterrupted or error-free; (b) any defects will be corrected; (c) the Service is free of viruses or harmful components; or (d) the results obtained from using the Service will be accurate or reliable.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, UNIVERSITY BUBBLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE PAST SIX MONTHS OR (B) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you.

11. Indemnification

You agree to defend, indemnify, and hold harmless University Bubble and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of another user or third party.

12. Termination

We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without prior notice or liability, for any reason, including violation of these Terms.

You may terminate your account at any time by following the account deletion instructions in the app or by contacting support@universitybubble.com.

Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimer of warranties, limitation of liability, and governing law) shall survive.

13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Lee County, Alabama, and you consent to the personal jurisdiction of such courts.

14. Changes to These Terms

We reserve the right to update these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and provide notice through the app. Your continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.

15. Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and University Bubble regarding your use of the Service and supersede all prior agreements and understandings. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
